The following terms and conditions shall apply to all users in relation to the services provided by platform " Outfinity EG " These Terms and Conditions come into force once You accept Service through the Platform or through any other form of communication with Outfinity EG.

Please note that You should review and agree with our Privacy Policy as it is an integral part of these Terms and Conditions. 

This Agreement supersedes any prior agreements or arrangements between Outfinity EG and You. Outfinity EG may immediately terminate this Agreement and/or any provision of Services thereunder, or generally cease offering or deny access to the Services or any portion thereof at its sole discretion, at any time for any reason, without incurring any liability towards You. 

The User agrees and accepts that the use of the Platform and the Services provided by Outfinity EG is at the sole liability of the User, and further acknowledges that Outfinity EG disclaim all representations and warranties of any kind, whether expressed or implied. 

Definitions

The following definitions apply to the Terms and Conditions set out below. These Terms and Conditions, along with the Privacy Policy, hereby set out the whole agreement and understanding between " Outfinity EG " and the “User” (the Agreement”). whether an individual or entity that accesses Our Platform.

“We”, “Us”, “Our”, the “Company”, “Outfinity EG” and “Platform” shall refer to Outfinity EG, its employees, and authorized agents.

Users: are individuals who benefit from the platform's services as outlined in this terms and conditions ,This includes "children" who use the platform under the supervision of their parents. 

Services: means Outfinity EG’s Services as described by these Terms and Conditions.

Platform: means the Outfinity EG Platform, which is owned by Outfinity EG for Trading and Supplies an LLC and registered in the Cairo Investment Commercial Register under No. 277575 which the services provided are used by users. 

Children: Refers to users who are children and benefit from the platform's services.

Parents: Refers to the parents or legal guardians of children who use the "Outfinity EG" platform.

Force Majeure: means an act of God, including but not limited to fire, floods, storms, hurricanes, typhoons, volcanic activities, or earthquakes, as well as acts, orders, or requests of a sovereign or a government and /or of anybody purporting to be or to act for such authority, wars, whether declared or not, war-like actions, revolutions, riots, civil insurrections, or civil commotions, as well as strikes, lockouts and/or similar actions in labor disputes, and any other comparable cause beyond the control of a party unless its performance has been expressly guaranteed by expressly waiving the exemption of a Force Majeure event.

Applicable Laws: means the laws of the Arab Republic of Egypt.

Eligibility

If you are registering as a business entity, you represent that you have the authority to bind that entity to Terms and Conditions and that you and the business entity will comply with all applicable laws and terms governing the use of the Platform.

Accounts and Registration

To benefit from the Services, you should provide Outfinity EG Platform with all required information in order to create your Account and allow Outfinity EG to provide you with the Services. Otherwise, you shall navigate the Platform as a guest.

Outfinity EG Platform may ask you to provide some personal data including but not limited to your full name, email address, mobile phone number, and some financial data. 

You agree to maintain true and accurate, complete, and up-to-date information in your Account. You are responsible for all activity that occurs under your Account, and as such, you agree to always maintain the security of your Account username and password, unless otherwise permitted by Outfinity EG in writing.

Accounts are not transferable. You agree to reimburse Outfinity EG for any improper, unauthorized or illegal use of your Account by you or by any person obtaining access to the Platform, Services or otherwise by using your designated username and password, whether you authorized such access.  

You agree that you are solely responsible for all activities that occur in connection with your account on Outfinity EG Platform and you shall notify us immediately of any unauthorized use of your account.

We may terminate or suspend access to your Account or your ability to use the Services, in whole or in part, at our sole discretion, for any or no reason, and without notice or liability of any kind. For example, we may terminate or suspend your Account or ability to use the Services if you misuse the Platform. Any such termination or suspension could prevent you from accessing your Account.

If Outfinity EG suspects, at its sole discretion, that any of the information you provided is untrue, inaccurate, incomplete, or not current, without prejudice to any other rights and remedies of Outfinity EG under these Terms and Conditions or under the Applicable Laws, we have the right to suspend or limit your access to the Platform and its Services.

Outfinity EG may (in its sole discretion and at any time), make any inquiries it considers necessary (whether directly or through a third party), and request that you provide a response with further information or documentation, including without limitation to verify your identity and/or ownership of your financial instruments. Without limiting the foregoing, if you are a business entity or registered on behalf of a business entity such information or documentation may include your trade license, other incorporation documents, and/or documentation showing any person's authority to act on your behalf. you agree to provide any information and/or documentation to Outfinity EG upon such requests. You acknowledge and agree that if you do not, Outfinity EG without liability may limit, suspend or withdraw your access to the Platform. We also reserve the right to cancel unconfirmed/unverified Accounts or Accounts that have been inactive for a long time.

All users registered on the platform must be parents or legal guardians of the children wishing to participate on the platform. Please ensure that you are legally responsible for the child registered on the online platform.

Outfinity EG offers a variety of services aimed at providing a unique and exceptional experience for users of the online platform who are interested in purchasing and browsing clothing products:

First: products varieties and description

The online platform provides multiple categories of clothing, including men's, women's, children's, sportswear, and special occasion attire.

 Each product has a dedicated page containing high-quality images, details about the materials used, available sizes, prices, and multiple color options..

Second: special offers and discounts

The online platform sends notifications to users regarding promotional offers, discounts, and new collections.

Additionally, the platform provides special offers during holidays and various seasons, helping to attract customers.

Third: helping tools

AI: The platform provides clothing recommendations based on the user's preferences and purchase history, making it easier for customers to find clothing that suits their taste.
Wishlist: The platform allows users to add products to a Wishlist for later review and purchase.
Additionally, the platform offers a tool for measuring personal dimensions or guides users in obtaining the correct measurements, assisting in the selection of the appropriate clothing size.

Fourth: Return and exchange policy

The platform offers a flexible return policy that allows customers to easily return or exchange products in case of defects or dissatisfaction.

Additionally, customers can request product exchanges or refunds through the application.

Fifth: purchase and payment methods 

The platform includes flexible payment options such as cash on delivery, credit card payments, or electronic payments.

Users can also store payment details for faster purchases in the future.

Sixth: Delivery and tracking

 The platform offers multiple delivery options and enables customers to track the status of their shipment in real time through the application.

Use of the Platform

Subject to the User’s compliance with these Terms and Conditions, Outfinity EG grant the User a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to:

-  Access and use the Services solely in connection with the provision of the Services.

- Access and use any content, information, and related materials that may be made available through the Services.

Any rights not expressly granted herein are reserved by Outfinity EG and may be revoked at any time without notice to the User.

The user shall not use any trademark or intellectual property rights of Outfinity EG. Also the user ot shall any reverse engineering or reconfiguration be performed or linking any part of the Services to any reflective system and no part of the Services may be copied or framed or any software or text launched for the purpose of scraping, cataloguing, surveying, or extracting data from services in any other way or overload or impede the operation of any aspect of services, or attempt to access unauthorized services or weaken any aspect of associated services, systems or networks. 

The User may not post in anywhere else on the site (as determined at our sole discretion): solicitation, advertising, foul language, profanities, obscenities, culturally offensive material, religiously offensive material, critical political content, material that may threaten the public interest or national security, defamatory or libelous harassment, or other content that may be offensive or indecent.

Outfinity EG offers some adventurous activities that may involve risks. We would like to emphasize that the responsibility for ensuring the safety of all tours lies solely and entirely with the user. The user must strictly follow the rules of the service provider during the trip.

Electronic Communications

By creating an account, you agree that you are communicating with Us electronically. Therefore, you consent to receive periodic communications from Us. Outfinity EG will communicate with you via e-mail or may send You information via text messages (SMS), as well as by posting notices on the Platform as part of the normal business operation of your use of the Services. You acknowledge that opting out of any of the said means of communication may affect your use of the Services.

You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Outfinity EG will request your agreement during the registration process to send you promotional emails or notifications related to the Platform and its Services. If at any time, you decide that you do not wish to receive promotional emails, you can opt-out of receiving such promotional emails by clicking on the link at the bottom of any promotional email.

Payments

Outfinity EG provides electronic payment services through electronic payment gateways. Payment will be processed through these gateways, and Outfinity EG is not responsible for any error, damage, or similar matter that the user may be exposed to as a result of or due to the use of the electronic payment method, as this is the responsibility of the user.

Outfinity EG reserves the right to alter, change, modify, or provide the payment methods and the fees of the Services without prior notice. However, such changes will be reflected on the Platform prior to You ordering.

You shall ensure sufficient coverage of the respective account that covers the orders and shall abide by the credit card transaction limits. The User shall agree to receive a receipt via email or text or through the Platform itself following Your payment of the fees.

Outfinity EG shall not charge the Users any extra fees for making an online payment. Except for administrative expenses, which represent a percentage of (............) % of the payments.

Outfinity EG Platform may (in its sole discretion and at any time), make any inquiries it considers necessary (whether directly or through a third party), and request that You provide it with further information or documentation, including without limitation to verify your identity and/or ownership of Your financial instruments. You agree to provide any information and/or documentation to Outfinity EG upon such requests. You acknowledge and agree that if You do not, Outfinity EG without liability may cancel the transaction, limit, suspend or withdraw your access to the Platform and/or your membership on the Platform.

Copyrights and Trademarks

All content included on the Platform including but not limited to text, graphics, Outfinity EG logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property and copyright work of, Outfinity EG or its licensors and is protected by copyright, trademarks, patents or other intellectual property rights and laws. The compilation of the content on the Platform. is the exclusive property and copyright of, Outfinity EG and is protected by copyright, trademarks, patents, or other intellectual property rights and laws.

Outfinity EG and related logos are the trademarks of Outfinity EG. Outfinity EG trademarks may not be used in connection with any product or Service that is not listed on the Platform or in any manner that disparages or discredits, Outfinity EG.

Data Privacy and Confidentiality

You hereby agree to the collection and processing of Your personal data by Outfinity EG. We are committed to protecting the personal data in accordance with Our Privacy Policy.

Disclaimer

You will use the services at your own risk. the services are provided “as is” and “as available.” Outfinity EG disclaim all representations and warranties, express, implied, or statutory, not expressly set out in these terms. in addition, Outfinity EG make no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the services or any services requested using the services, or that the services will be uninterrupted or error-free. Outfinity EG does not guarantee the quality, suitability, or ability of the services. You agree that the entire risk arising from the use of services remains solely with you, to the maximum extent permitted under applicable law.

Limitations of Liability

Outfinity EG shall not be liable to You for indirect, incidental, special, exemplary, punitive, or consequential damages, lost data, or damage to Your bank account or Your Outfinity EG account, even if Outfinity EG has been advised of the possibility of such damages. Outfinity EG shall not be liable for any damages, liability, or losses incurred by You arising out of Your use of or reliance on the Services or Your inability to access or use the Services or any transaction, even if Outfinity EG has been advised of the possibility of such damages.

Outfinity EG shall not be liable for delay or failure in performance resulting from causes beyond Outfinity EG `s reasonable control. These limitations do not purport to limit liability that cannot be excluded under the Applicable laws.

Outfinity EG shall be entitled to disclose any User information it may possess to affiliated corporate entities within its group of companies, or if required by law, or if requested or directed to do so by any official government body. Outfinity EG will do so at its sole discretion or as We may determine to be suitable or in Our best interest to do so.

Outfinity EG shall be entitled to add to, vary or amend any or all these Terms and Conditions at any time without notice. The User shall be bound by any additions, variations, or amendments once incorporated into these Terms and Conditions on Outfinity EG Platform.

These limitations do not purport to limit liability that cannot be excluded under the Applicable laws.

Indemnification

You agree to indemnify and hold Outfinity EG, its affiliates, sponsors, partners, directors, officers, and employees harmless from and against, and to reimburse Outfinity EG with respect to, any and all losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses (including reasonable related expenses, legal fees, costs of investigation) arising out of or relating to Your breach of this Terms & Conditions, along with Our Privacy Policy or use by You or any service provider of the same Services.

Exceptions

In cases of emergencies or force majeure, exceptions to this policy may be considered at the discretion of the Outfinity EG Platform management. In such cases, users must contact the Outfinity EG Platform support team to submit an exception request with a detailed explanation of the force majeure circumstances and supporting evidence. The support team will respond to the user with a decision to approve or deny the request. 

Refund policy

Outfinity EG apply the provisions of the Consumer Protection Law No. 181 of 2018 regarding the exchange/ refund policy.

Outfinity EG will reserve the right to cancel the order at any time at its sole discretion and shall notify You on the cancellation via text messages or the Platform. No amount will be charged in such a case.

Force Majeure 

Outfinity EG shall not be liable for any delay, interruption, or failure in the provisioning of Services if caused by acts of God, including but not limited to declared or undeclared war, fire, flood, storm, slide, earthquake, power failure, "Force Majeure”, the inability to obtain equipment, supplies or other facilities that are not caused by a failure to pay, labor disputes, or other similar events beyond Our control that may prevent or delay Service provisioning.

Links to Third Party Platforms

Our Platform may contain hyperlinks to platforms operated by parties other than Outfinity EG Such hyperlinks are provided for your reference only. We do not control such platforms and are not responsible for their contents or the privacy or other practices of such platforms. These Terms and Conditions will not apply to your use of any third-party platform that you access via our Platform. Your use of any third-party platform may be subject to additional terms and conditions, which we suggest you read carefully before you visit any such platform. 

Applicable Laws

The rights and obligations of the parties pursuant to this Terms & Conditions are governed by and shall be construed in accordance with the laws of the Arab Republic of Egypt.                

You hereby irrevocably submit to the exclusive jurisdiction of the Courts of the Arab Republic of Egypt for any dispute arising under or relating to this Terms & Conditions and waive Your right to institute legal proceedings in any other jurisdiction. We shall be entitled to institute legal proceedings in connection with any matter arising under these Terms & Conditions in any jurisdiction where you reside, do business, or have assets.  

Where there is any dispute or inconsistency arising from the text of these Terms &Conditions, the Arabic version shall prevail.

Unenforceable Provisions

If any part of these Terms & Conditions is found to be invalid or unenforceable under Applicable law, such part will be ineffective to the extent of such invalid or unenforceable part only, without affecting the remaining parts of the Terms &Conditions in any way.

Entire Agreement

This Agreement along with Outfinity EG Privacy Policy constitute the entire Agreement between You and Outfinity EG regarding the use of the Platform and the Services and supersedes all previous negotiations or agreements both orally or in writing regarding the subject matter of this Agreement.

We reserve the right, at Our sole discretion and at any time, to update, change or replace any part of these Terms and Conditions by posting updates and changes to Our Platform. It is Your responsibility to check Our Platform periodically for changes. Your continued use of or access to the Platform or the Service following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes.

Third Party Services

The Services may be made available or accessed through Third-Party Service Providers and content (including advertising) that Outfinity EG do not control. You acknowledge that different terms of use and privacy policies may apply to you for use of such third-party services and content. Outfinity EG do not endorse such third-party services and content and in no event shall Outfinity EG be responsible or liable for any of the services of these Third-Party Service Providers.
